Canadian products shift into and out of the 50% Section 338 duty
The 50% additional ad valorem Section 338 duty is removed from certain Canadian products and imposed on other Canadian products under the October 23 proclamation. The changes, including the related HTSUS modifications in Annex II, apply to goods entered for consumption or withdrawn from warehouse for consumption on or after October 30, 2026. The additional duties apply in addition to Section 232 duties.
The product’s treatment under Annex I controls: Part A identifies products no longer subject to the additional 50% duty, while Part B identifies products newly subject to it. The Part B duty does not apply to civil aircraft or aircraft parts meeting HTSUS General Note 6. Annex I says its product descriptions are informational and do not delimit the action’s scope; it directs questions about the scope of particular HTSUS provisions to CBP. Annex I governs which products fall on each side of that line. (White House)

Amphenol Optimize facility entries return to liquidation
The suspension of liquidation is lifted for unliquidated entries of goods from the Amphenol Optimize facility: USTR says the condition in section 752(b) has been met and its letter no longer directs suspension. On October 23, 2026, USTR said it directed the Secretary of the Treasury to resume liquidation and asked that DHS and CBP officials be informed. (USTR)
The dividing line is the source facility and the entry’s liquidation status. The direction covers all unliquidated entries of goods from the Amphenol Optimize facility in Sonora, Mexico; it does not cover entries already liquidated, and the letter does not extend its direction to goods from other facilities. The stated change is resumption of liquidation, not a new duty rate. (USTR)
