Executive Summary
Commerce’s October 5, 2026, preliminary review notice reports a 13.11 percent preliminary dumping margin for Colakoglu and Ekinciler, but it does not make that rate the new cash deposit rate now.
Final results will determine assessment rates for covered entries and, when applicable, future cash deposits. The notice sets a separate 3.90 percent all-others deposit rate for other manufacturers or exporters after final results take effect.
Commerce rescinded the review for three listed companies because it found no reviewable, suspended entries for them during the period of review. Their entries are to be assessed at the cash deposit rate in effect at entry.
Importers and interested parties should identify the producer and exporter, check which review period covers their entries, and calendar the comment, hearing and liquidation-related dates.
An AD/CVD review notice can announce preliminary margins without changing cash deposits immediately. In its Türkiye rebar preliminary review notice, published October 5, 2026, Commerce preliminarily calculated a 13.11 percent dumping margin for two companies and rescinded the review for three others.
The notice concerns the antidumping duty order on steel concrete reinforcing bar from Türkiye, for entries during July 1, 2024, through June 30, 2025. It is not a countervailing duty review. The notice’s reimbursement reminder refers to antidumping duties and/or countervailing duties, but the results and rates discussed below are antidumping findings.
What Does a Preliminary AD/CVD Review Rate Mean?
The 13.11 percent figures are preliminary weighted-average dumping margins, not new cash deposit instructions effective on October 5. Commerce calculated that margin for Colakoglu Metalurji A.S. and Colakoglu Dis Ticaret A.S., the jointly identified mandatory respondent, and preliminarily assigned the same margin to Ekinciler Demir Ve Celik Sanayi A.S., which was not individually examined.
Preliminary results are an interim stage. Interested parties can submit case briefs and rebuttal briefs, and Commerce will issue final results afterward. The notice says the final results will provide the basis for assessing duties on entries covered by those results and for future deposits, where applicable.
For importers, match the entry’s producer and exporter to the notice and the review period before treating a published percentage as relevant. The notice describes rebar from Türkiye as covered merchandise, and directs readers to the Preliminary Decision Memorandum for the complete scope.
How Do Assessment Rates Differ From Cash Deposits?
An assessment rate determines duties on covered past entries after final results, while a cash deposit rate applies to covered shipments entered for consumption after final results are published. Commerce says it will determine assessment rates and CBP shall assess duties in accordance with the final results.
For Colakoglu, if its final margin is not zero or de minimis, Commerce intends to calculate importer-specific assessment rates using the dumping amount for each importer’s examined sales divided by their entered value. If entered values are unavailable for all sales to an importer, it intends to calculate a per-unit rate using quantity, with an ad valorem ratio to test whether the rate is de minimis. Zero or de minimis rates lead to liquidation without antidumping duties under the stated conditions.
For Ekinciler, the assessment rate will be based on the review-specific rate. For the three rescinded companies, assessment is different: CBP is to use the cash deposit rate required when the entry was made or withdrawn from warehouse for consumption.
What Is the All-Others Rate in the Rebar Notice?
The 3.90 percent all-others rate is a cash deposit rate for other manufacturers or exporters after the final results take effect, not the preliminary 13.11 percent review margin. The notice says previously investigated or reviewed companies not covered by this review keep their company-specific rate from their most recently completed segment.
If an exporter was not covered in this review or the less-than-fair-value investigation, but the manufacturer was, the manufacturer’s rate from the most recent segment applies. For other manufacturers or exporters, the deposit rate continues at 3.90 percent, established in the amended final determination of the investigation.
The notice also addresses entries produced by Colakoglu for which it did not know the goods were destined for the United States. Commerce intends to direct assessment at the investigation’s all-others rate if no rate exists for an intermediate company.
Which Rebar Companies Had Their Review Rescinded?
Commerce rescinded the review for three company groups because there were no reviewable, suspended entries of their merchandise during the review period. It had notified interested parties of its intent to rescind and invited comments; no party commented.
The companies named are Habas Sinai ve Tibbi Gazlar Istihsal Endustrisi A.S.; Icdas Celik Enerji Tersane ve Ulasim A.S.; and Kaptan Demir Celik Endustrisi ve Ticaret A.S. and Kaptan Metal Dis Ticaret ve Nakliyat A.S. Rescission means Commerce will not calculate review-specific rates for these companies in this review. The notice directs CBP to assess appropriate entries at the cash deposit rate in effect when they entered.
Commerce intends to issue rescission instructions to CBP no earlier than 35 days after publication. If a timely summons is filed at the U.S. Court of International Trade, the instructions will direct CBP to hold relevant entries until the period for requesting a statutory injunction expires.
What Are the AD Review Notice Dates?
The notice sets deadlines for comments and a hearing, and ties new cash deposit requirements to publication of final results.
- Publication and applicable date: October 5, 2026. Commerce published the preliminary results.
- Disclosure: within five days. If there is no public announcement, disclosure is due within five days of publication.
- Case briefs: 21 days after publication. ACCESS must receive the filing by 5:00 p.m. Eastern Time on the established deadline.
- Rebuttal briefs: five days after the case brief deadline. Rebuttals are limited to issues raised in case briefs.
- Hearing requests: within 30 days after publication. The request must reach ACCESS by 5:00 p.m. Eastern Time.
- Rescission instructions: no earlier than 35 days after publication.
- Injunction period: within 90 days of publication.
These deadlines run from the October 5, 2026, publication date, except the rebuttal deadline, which runs from the case brief deadline. The notice does not make any of these deadlines the final results date.
What Should Importers Do After This Rebar Notice?
Match entries to the review. Identify the merchandise, producer, exporter and entry dates, then determine whether an entry falls within July 1, 2024, through June 30, 2025, and whether its company was reviewed or rescinded.
Keep deposits separate from final liability. Do not treat the preliminary 13.11 percent margin as the cash deposit rate currently required. Track final results and apply the deposit rules in the notice to shipments entered on or after their publication.
Check liquidation exposure. For entries associated with a rescinded company, retain the entry-time cash deposit information. Review whether a summons or injunction affects liquidation before relying on a routine liquidation schedule.
File reimbursement certificates. Before liquidation of relevant entries during the review period, file the certificate concerning reimbursement of antidumping duties and/or countervailing duties. The notice warns that failure can lead to a presumption of reimbursement and double antidumping duties, or an increase in antidumping duties by the amount of countervailing duties.
What Does the Türkiye Rebar Notice Leave Open?
The notice does not state the final margins, the final importer-specific assessment amounts, or when Commerce will publish final results. It also does not reproduce the complete order scope, directing readers to the Preliminary Decision Memorandum for that description. Until final results issue, the 13.11 percent figures remain preliminary, and the notice’s future deposit instructions remain tied to publication of those results.
