Canada goods: 50% Section 338 duty scope changes
The 50% Section 338 additional duty no longer applies to specified Canadian goods, while 100 additional HTSUS classifications become subject to it, for goods entered for consumption or withdrawn from warehouse for consumption on or after October 30, 2026. The proclamation makes the changes effective at 12:01 a.m. eastern time, and CBP directs filers to report covered goods under heading 9903.03.14. (White House, Oct 23, 2026)
The classifications CBP identifies as removed from the 50% duty are 1212.21.00, 3920.20.00, 3923.10.90, 3923.21.00, 4412.33.06, 4412.33.26, 4412.33.32, 4412.33.57, 4412.34.26, 4412.34.32, 4412.34.57, 4811.51.20, 4811.51.40, 4819.10.00, 4819.40.00, 4823.70.00, 4823.90.10, 8418.69.01, 8419.89.95, 8422.30.91, 8422.40.91, and 8433.60.00. The proclamation’s Annex I, Parts A and B, and CBP’s “Section 338 Canada Modified HTS LIST 10.25.2026” govern which products are removed or added; the latter identifies the 100 additional classifications. The dividing line is the entry or warehouse withdrawal date, not the shipment date. (White House, Oct 23, 2026)
For goods properly entered under Chapter 98, the additional duties under headings 9903.03.12 through 9903.03.14 do not apply when CBP agrees that Chapter 98 entry is appropriate, except for subchapter XXIII of Chapter 98 and subheadings 9802.00.40, 9802.00.50, 9802.00.60, and heading 9802.00.80. For the three listed 9802 subheadings, the duty applies to the value of repairs, alterations, or processing; for heading 9802.00.80, it applies to the value of the article assembled abroad, less the cost or value of U.S. products.

Brazilian aluminum foil: CBA 13.65% margin; 13.93% all-others deposit
A 13.65% weighted-average dumping margin now applies to Companhia Brasileira de Alumínio and CBA Itapissuma Ltda., which Commerce treats as one entity, and their cash deposit rate is 13.65% for covered shipments entered or withdrawn for consumption on or after October 30, 2026. Other producers or exporters not covered in this or a prior segment or the original investigation remain subject to the 13.93% all-others deposit rate; the notice preserves the most recent company-specific rate for other firms covered in an earlier segment.
The order covers aluminum foil from Brazil, but the Issues and Decision Memorandum governs the complete product scope. For CBA-produced entries during the November 1, 2023–October 31, 2024 review period, Commerce will calculate importer-specific assessment rates; if a rate is below 0.5%, CBP will liquidate that importer’s entries without antidumping duties. For CBA-produced entries where CBA did not know the goods were destined for the United States, CBP will use the all-others rate if no rate exists for an intermediate company. Importers must file the reimbursement certificate before liquidation or Commerce may presume reimbursement and assess double duties.
Commerce intends to issue assessment instructions to CBP no earlier than December 4, 2026, 35 days after publication. If a timely summons is filed at the Court of International Trade, CBP’s instructions will prevent liquidation of relevant entries until the period to request a statutory injunction expires; parties must request that injunction within 90 days of publication, by January 28, 2027.
